  He deserted the family leaving his wife and 3 young children and disappeared with his 'lady love' never to be heard of again. On 6 July 1898, John Fletcher Smailes was sentenced to 3 years imprisonment for theft and sent to the Ladybrand jail. On 14 August 1898, JF Smailes wrote a letter to the Landdrost requesting to be moved from the Ladybrand jail to another jail. The reason for the request is that prisoner H Elliot "was a threat to his life" and Elliot had harmed him and was planning to do more harm. The letter of JF Smailes is acknowledged by the Landdrost of Ladybrand and sent onto Bloemfontein where the receipt is acknowledged. A letter dated 16 January 1899 from Bloemfontein requesting the release of JF Smailes and Diamond because of chronic ailments. It refers to a letter of the District Surgeon dated 30 December 1898 indicating that JF Smailes was suffering from Chronic Syphilis. His release is approved. Mrs AM Reyneke owned property in Zastron and JF Smailes and Elizabeth Anna Stephina Smailes were staying on Erf 66. Mrs Reyneke took JF Smailes to court to get him off the property because he was not paying any rent. Elizabeth AS Smailes, as one of the witnesses, states that the property belonged to her late husband, Petrus Johannes Botha because the late Mr Reyneke owed him money and could not pay. She (EAS Smailes) states she has been living there for 30 odd years. The court issued an order of Ejectment from Erf 66 John Fletcher Smailes is found guilty of contravening Section 41 of Ordnance no 8 of 1903 and sentenced to pay £5 fine or one month IHL (something about hard labour). It is noted that JF Smailes is 70 yeas old.
