    Notes:

    He was a Sergeant in the 38th Regiment of Foot (the South Staffordshires). He served in Wellington's campaign in the Spanish Peninsula and was present at the battles of Vittoria and San Sebastian in 1813 and at Nives in 1814. He arrived in South Africa with his regiment on 2 November 1818 and was a member of the Grahamstown garrison, being discharged from the army in 1830. Robert was born on the 27th June 1790 at Molton, Deven and baptised in Chittlehampton in the same year. He was one of ten children. Legend has it that Robert, in consequence of a qualrrel with his father, ran away from home, and, on the 14th March 1808, giving his age as eighteen years, enlisted in the district of Birmingham as a private in the second Battalion of the 38th Regiment of Foot (afterwards known as the South Staffordshire). His military record states as follows: Transferred 1st Battalion on the 25th November 1814; promoted Corporal 17th March 1818; embarked for Cape of Good Hope 12th June 1918; disembarked at Cape Town 2nd November 1818; transferred (by order of Lord Charles Somerset) to Cape Infantry 25th October 1819; transferrred to Cape Cavalry 25th March 1827; Acting Garrison Sergeant, Grahamstown from January 1830; discharget to Out Pension 25th September 1830 per War Office Authority dated 23rd June 1830.

    220. SAMUEL WARNER and WILLIAM FINAUGHTY were indicted for feloniously stealing, on the 19th of February , a pound weight of opium, value 8 s. two pounds weight of cheese, value 1 s. two ounces of bees-wax, value 1 s. the property of the London Dock Company .

    SECOND COUNT for like offence, only varying the manner of charging it.

    ALEXANDER LOW . I am foreman of the warehouse, No. 4, in the London Docks ; Warner was a labourer in the warehouse , Nos. 3 and 4; Finaughty was a carman . There was opium and cheese on the quays, and in the warehouse, No. 3, there was bees wax. On the 19th of February last, I saw Warner come round the back of the warehouse and give Finaughty a mat in his hand; he throwed it in his cart. I asked Finaughty, what he had got in his cart; he said, it was nothing to me. I called Latter, the watchman, and then Finaughty throwed it out of the cart. The watchman opened the mat; this bag was rolled up in the mat; the bag contained this cheese, opium, and bees wax. There was bees wax in both the warehouses, and cheese and opium were on the quays.

    MICHAEL LATTER . I am a watchman in the London Docks. I apprehended both the prisoners. I examined the mat when Finaughty put it out of the cart, and found the contents were opium, bees wax, and cheese. I have had it ever since.

    Warner's Defence. This man asked me for an old mat; I saw two pieces of old mats behind the wine casks, I chucked them up in the cart. What was in them, I did not know.

    Finaughty's Defence. I saw Warner coming along, I asked him if he had got a bit of old mat to give me; he fetched this, and I throwed it into the cart. Mr. Low asked me, what it was; I told him, it was an old mat. I did not know any thing was in it.

    WARNER, GUILTY , aged 48.

    FINAUGHTY, GUILTY , aged 30.

    Confined Six Months in the House of Correction , and whipped one hundred yards near the London Docks .

    Notes:

    This is quite a challenge of a family! It appears that William and Lucy Moles must have married in about 1803 somewhere in London. They had four children, Lucy Moles Finaughty, George William, Joseph and John Henry. Joseph must have died young because he did not go to South Africa with the 1820 settlers.

    On 26 February1810 a William Finnaughty was sentenced to imprisonment for larceny(theft). Engand and Wales Criminal registers 1791 - 1892 held at the National Archives under Class HO 26; piece 16, page 32. William was sentenced to 6 months in jail and a flogging. see http://www.oldbaileyonline.org/browse.jsp?id=t18100221-73&div=t18100221-73 Is this where William departs the scene, and Henry Ulyate or Ullyate moves in? We have not been able to find a marriage for Lucy and Henry. Lucy's next 3 children all have Ulyate as a second name, and they 'drop' the Finaughty when they embark as 1820 settlers to South Africa, and subsequent children with Henry do not have the Finaughty name, but Ulyate.

    Robert PIRIE was married twice. His first wife was Elizabeth UNKNOWN to whom he was married in 1807 in England. She died in England before he emigrated to the Cape. Their daughter was Margaret PIRIE born about 1808 d 20 August 1897.
    His second wife was Mary 'Rache' (she was known as Rachel in the family, not Mary) in England. She was born about 1795 in England.
    They had 4 children (Robert PIRIE) we know nothing about him other than a mention in the Lower Albany Chronicles:
    2 November 1843. John RICHARDSON had been attacked by a leopard while hunting it on Thorn Hill. H brought it to the ground. He was rescued by Mr. Pirie (his step-son) who killed the animal with his knife.

    He is also mentioned in his father's will.
    "....which I leave to my dear children Robert, Sarah Ann, Mary Ann and Elizabeth PIRIE at the death of their mother." Signed Robert PIRIE.
