    [Although James and Tabitha were on the same ship as the other Hayward brothers (ie. James, William and George), he was not directly related to these brothers as he came from a different region in England. The parish of Westbury paid James the sum of £22:10:0 towards the costs of travelling to the Cape. References refer to him as 'James the elder', clearly to distinguish him from the other James settler (a1) who was some thirteen years younger]."

    James Hayward's will reads as follows:
    Know all men by these present I James HAYWARD born in Hopperton near Trowbridge Whiltshire [sic] England, being of sound mind to make this my last will and testament
    First I will that at my death all my just debts be paid by my executors
    Second that the sum of ninety pounds sterling lent by me to John WILMOT of Spring Vale about ten years ago I bequeath to my wife Sarah HAYWARD (born WILMOT) with all interest due thereon.
    Third the remainder of my Estate of whatever kind and wherever situate I bequeath to my three daughters Elizabeth RIKKARDS, Selina HODGKINSON and Eliza RANDALL, share and share alike.
    Fourth I hereby constitute and appoint Selina HODGKINSON Executrix to this my will
    Done by me at Bathurst on this 23rd day of November 1861
